so aparently someone at the city of farmington hills really has a boner for me.

i've been waiting since november to purchase a XD-.40 cal from a friend of the family. I put my permit to purchase application in on feb 11th, and just a few days ago (3/6) received my denial of liscence to purchase. Normally you have an answer the week following on thursday of your application date.

While i was under investigation i found out that one of the officers looking into my ability to purchase had investigated me on some criminal charges as the lead detective 12 years ago. The way the case played out - currently i have no legal history that will prevent me from owning/purchasing rifles/handguns.

Long story short i now have to hire a lawyer and fight the decision through ligitation in the local Circuit court. At this point.. its not about purchasing THIS gun.. but my ability to purchase guns period.

*sigh* what a pain in the ass. Time for me to go join the NRA i guess

i'll keep you guys posted as to whats up with it.

X2. I'm getting pretty sick of the local govt. here. I got pulled over for doing 53 in a 45. The cop just gave me a warning for my speed but, come to find out my drivers license was expired 6 months ago! He gave me a ticket for it. Of course I get my licensed renewed ASAP. I go to court to try to see if they will drop the charges. The judge was a total prick. She didn't drop the fines for one single person in the court that day. Cost of forgetting to renew my license = $244. Lately the cops around here have been pulling people over right and left. It's like a speed trap. Then Friday on the way home a cop whips out in front of me, so I have to put on the brakes then hauls butt doing at least 50 in a 35 with no lights on and never pulls anyone over. I followed him for about a mile through several stop lights. He was riding people until they would move over and then speed by. My wife has had the same thing happen to her.
I got a haircut that day and told the lady that cuts my hair about it and she told me alot of people had the same story. She knows the Mayor and said she was going to talk to her about it. Her son had also been harassed by the cops just recently.:irked_125 My hairstylist also knew the judge and said she has had several bad dealings with her also. BTW she [my hairstylist] cuts the mayors hair. She's been in business here in Purcell for over 20 years so she knows alot of people. I hope she can get something done. Rant over.

You guys need to move to FL all you gotta do is get a backround check and as long as you don't have a record they don't care what didn't stick. Get you permit and buy ALL you want/can afford. Plus the women are hot and the weather is great. Mike knows just ask him.

quick update.
Joined the NRA today, talked to their ppl - found a good lawyer they recomended here locally. He said sounds just like overzealousness and that i should stop in to see him in the morning and we'll get started into the process.

i should know in 24 hours how expensive this all will be *sigh*

i imagine that since i'm really getting ready to poop in the local PD's front yard its about time for me to quit smokin ye ole reefer for about a year or so heheheh. Dont need to give them any excuses to screw with me until i can move my butt outa this city.

quick update:
talked to the NRA lawyer today. he says what i'm dealing with is definatly win-able in court. The retainer fee was about what i expected it to be, but the estimated Long term ligitation costs (assuming the good-old boy network 'let me pull some strings' doesnt pan out) seemed a little on the high side of things @ around $5k.

So i'm off to russle a few more bushes of my own and start me a fundraising campaign.

Here's to hopeing that the one main question i havent asked yet is a good assumption - i dont have to put up this kind of fight with every gun purchase i ever make

damn dude, that sucks. keep the fight up and i hope you win it. but i think that a 5000 dollar fee is worth bein able to buy a gun for the rest of your days.

that sucks. Missouri lifted the waiting period last year. So now all you have to do if your of 21yrs or older you just walk in get the one they want they call it in 5minutes later your out the door if you have no felonies. :) OH btw AK is pretty much sold:( so im saving up for a Kimber .45 1911 w/ stainless steel bull barrel (5") and double stack mags with a barrel compesator it will run me about 1200$ hehe but thats a year away unless i can talk the ol man into buyin it for me

Yup. I just hope it doesnt turn into a revolving charge.

Whats really grabbin my goat about this whole deal is i've already paid that $5000 + $1700 in H.Y.T.A. (michigan first time / youth offender) probation fee's, + several hundred in other court oversight fees. Hell... the program went soo smoothly that my prob. officer even tried to get me out 6 months early. HYTA rules say that upon successful completeion all charges are to be expunged.

csl2006
03-12-08, 01:16 AM
do you have a felony on your record or were the charges dropped?

plant.one
03-12-08, 01:53 AM
If you were sentenced under Michigan's Holmes Youthful Trainee Act, you were arrested, charged, and entered a guilty plea, but if you successfully complete your probation you are not convicted - that is, upon successful completion of HYTA probation no conviction is entered in your record.

I did successfully complete my HYTA Program. In fact my probation officer was soo bored with me she recomended my early release every month for the last 6 months of my program hehehehe. I do not have a felony conviction on my criminal record. The only criminal conviction on my record is a mistamenor distributing to minors (alcohol) around 8 years ago. I also have several traffic voilations - the last of which happened in excess of 2 years past. I've never been charged with a firearms related charge, never been charged with a violent crime, never had any alcohol charges against me, no PPO/restraining orders ever.

its a real stumper. trust me.. you guys cant beleive the rash of grief i'm getting from friends and family who are in total disbeielf over this whole thing.

quick update - good news!

1 ) Found a little bit more affordable laywer :D
this coming week we'll be sending the city a friendly letter asking them to kindly reconsider their position on my liscence to purchase. This guy has handled several lately with the city of FH and has been able to resolve them with little or no trouble when he mentions that a successful ligitation through the courts of the denial will be followed by a counter suite for court costs and legal feels.
for $50 and a copy of my criminal record from the michigan state police - i'm willing to go this route hehehe

2 ) Have been doing my homework with some help from the folks over at expertlaw.com forums on sorting thru michigan law and can say for sure (as i knew before i applied) that i havent done ANYTHING listed that would specifically preclude me from owning/posessing a handgun.

at this point, it just looks like a small delay before i can buy my XD

My buddy got his new 8" stainless steel S&W .500 mag in today. We went out to shoot it fearing the worst and i thought i'd have to be picking him off the ground but honestly for being a .500 it kicks less than a .44mag and the equilivant to a .45acp in both our opions. Its a sweet ass shooting gun. Low recoil and a hellacious 300gr bullet packed behind it. We're hopefully goin to the range this weekend if weather permits so I'll snap some pics of the beast.

indeed....you just look at it and you fear to shoot it. Its huge granted but the kick is nothing. If I had 1100$ I'd get one but eh 32$ for 20rnds is alot to shoot.

fair price. They sold one similar to that at a farm auction here awhile back. I swear i never laughed so hard in my life. Junk guns selling for 600$ or more. A .22 winchester single shot (one that you can pick up at a pawn shop for 80-90$) sold for 450$ and it was in junk condition but it was for a good cause (guy was killed on a atv accident older farmer. was hit by a drunk russian kid driving on the wrong side of the road while the farmer was checking his fences)

come to find out my drivers license was expired 6 months ago! He gave me a ticket for it. Of course I get my licensed renewed ASAP. I go to court to try to see if they will drop the charges. The judge was a total prick. She didn't drop the fines for one single person in the court that day. Cost of forgetting to renew my license = $244.

Moral of the story... Renew your license when it's supposed to be renewed. No offense, but I have about as much sympathy for that story as I do for my brother when he was ticketed for lapsed registration and inspection.

About 2 years ago I had to renew my license. Drove to PennDOT, took a number... and waited. Then some more. Then a little longer. Finally I get to the counter and hand the lady my license. She tells me that I can't renew my license yet! She says it expires 5/31/06, I told her it was May 28! I came in 3 days before it expires to keep it legal! I call over her supervisor. He tells me the same story. My next question was " So I am supposed to drive here on an expired license to get a renewal?"

"Yes." she said

"So If I get pulled over and fined for driving under an expired license, are you going to pay it?"

"No. Just don't get caught."

A fine example of Pennsylvania's efficient Dept. of Transportation and the mongoloids they hire. Needless to say I came back three days later for the renewal.

I Take a number, wait to be called, then go to the counter. Same lady as before. I give her my EXPIRED license... "Oh this one isn't so bad!." I've never struck a woman or a state employee before... but I was pretty close to experiencing the feeling of doing both at once. What a dumb bi+ch

Isn't expired today the same as expired next year? I wonder if I had been pulled over, if the cop would have said the same thing. " Oh, this one isn't so bad. I'll only give you a half price ticket for driving on a one day expired license."

Freaking morons.
